Terms of service

1. About us

This website is operated by Diavola Ltd, trading as COG Outlet (“COG Outlet”, “we”, “us” or “our”).

Diavola Ltd is a company registered in England and Wales under company number, 17155392, with its registered office at 18 May Tree Close, Marlow, SL7 3YA.

You can contact us by email at customerservice@cogoutlet.uk.

These Terms of Service apply to your use of our website and to purchases made from COG Outlet through this website. Please read them carefully before placing an order.

Nothing in these Terms affects your statutory rights as a consumer.

2. Our website

Our website and online store are hosted by Shopify, which provides the ecommerce platform that enables us to sell our products to you.

You may use our website only for lawful purposes. You must not misuse the website, attempt to gain unauthorised access to it, introduce malicious software, interfere with its operation or use it in a way that infringes the rights of another person.

We may update, change, suspend or withdraw parts of the website from time to time.

3. Products

We take reasonable care to ensure that product descriptions, specifications, photographs and other information displayed on our website are accurate.

Product images are provided for illustrative purposes. Colours and appearance may vary slightly depending on lighting, photography and the device or screen used to view the website.

Where a product has particular characteristics, variations or limitations, these will be stated in the relevant product listing where applicable.

All products are subject to availability. We may change or discontinue products without notice.

Nothing in these Terms limits your statutory rights in relation to goods that are faulty, not as described or otherwise fail to meet the requirements of applicable consumer law.

4. Prices

The price payable for a product will be the price displayed on our website when you place your order, subject to correction of obvious errors.

Prices are shown in pounds sterling (£).

Delivery charges, where applicable, will be shown before you complete your purchase.

We reserve the right to change our prices at any time, but changes will not affect orders that we have already accepted.

If we discover an obvious pricing or product-information error after you place an order, we may contact you to explain the error and give you the option of proceeding on the correct basis or cancelling the order for a full refund.

5. Placing an order

When you place an order through our website, you are offering to purchase the products in your basket.

After placing an order, you will receive an electronic acknowledgement or confirmation. A contract between you and us is formed when we accept your order.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • there has been an obvious pricing or listing error;
  • we are unable to obtain authorisation for payment;
  • we cannot deliver to the address provided; or
  • we reasonably suspect fraud or misuse of our website.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.

6. Payment

Payment must be made using one of the payment methods offered at checkout.

You must provide accurate and complete billing, contact and payment information.

Payment is processed through the payment services available through our online store. We do not guarantee that every payment method will be available for every transaction.

7. Delivery

We currently deliver to eligible UK addresses in accordance with the delivery options shown at checkout.

Available delivery methods, charges and estimated delivery times will be displayed during checkout where applicable.

Any delivery dates or times provided are estimates unless we have expressly agreed otherwise with you.

We aim to dispatch orders promptly and, unless another delivery period has been agreed, goods will be delivered within the period required by applicable consumer law.

We are responsible for the goods until they are delivered into your physical possession, or into the physical possession of a person you have identified to receive them, except where applicable law provides otherwise.

Please ensure that the delivery information supplied with your order is complete and accurate.

Further information is available in our Shipping Policy.

8. Your right to cancel an online order

If you are a consumer purchasing goods through our website, you normally have a legal right to change your mind and cancel your purchase without giving a reason.

The cancellation period expires 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods.

If an order contains multiple goods delivered separately, the cancellation period generally runs from the day after you receive the last item.

To exercise your right to cancel, you must clearly inform us of your decision before the cancellation period expires. You can contact us at: customerservice@cogoutlet.uk

You then have a further 14 days from notifying us of the cancellation to return the goods.

Your cancellation rights may not apply to certain products where an exemption under consumer law applies, including certain personalised, made-to-order, perishable or sealed goods where applicable.

Full details are set out in our Return and Refund Policy.

9. Change-of-mind returns

Unless we state otherwise or the goods are faulty, you are responsible for the direct cost of returning goods when exercising your statutory right to cancel.

You must take reasonable care of the goods while they are in your possession.

You may inspect and handle a product to the extent reasonably necessary to establish its nature, characteristics and functioning, in a similar way to how you could reasonably inspect it in a shop.

If you handle the goods beyond what is reasonably necessary and this reduces their value, we may make an appropriate deduction from the refund where permitted by law.

Where possible, products should be returned with their original packaging, accessories and components. The absence of original packaging does not by itself remove your statutory cancellation rights.

10. Refunds following cancellation

Where you validly exercise your right to cancel, we will refund the price paid for the returned goods.

Where applicable, we will also refund the cost of our least expensive standard delivery method. If you selected a more expensive delivery service, such as an express or premium service, we are not required to refund the additional cost above our standard delivery charge.

We may withhold the refund until we have received the goods back or you provide evidence that you have sent them back, whichever occurs first.

Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.

We will process refunds within the time required by applicable consumer law.

11. Faulty, damaged or incorrectly supplied goods

Your rights concerning faulty goods are separate from your 14-day right to change your mind.

Under the Consumer Rights Act 2015, goods supplied to consumers must, where applicable, be:

  • of satisfactory quality;
  • fit for their intended purpose; and
  • as described.

If an item arrives damaged, is faulty, is materially not as described or you receive the wrong item, please contact us at customerservice@cogoutlet.uk with your order details and information about the problem.

Depending on the circumstances and your statutory rights, you may be entitled to a repair, replacement, price reduction or refund.

Where goods are being returned because they are faulty or do not conform to the contract, we will meet our obligations regarding reasonable return costs as required by law.

Nothing in these Terms excludes or restricts your statutory rights.

12. Returns purchased in person

The statutory 14-day cancellation right described above generally applies to distance contracts, such as purchases made through our website.

It does not generally apply simply because you change your mind about goods purchased from us in person, for example at an event, show or market where the relevant contract is an on-premises contract.

This does not affect your statutory rights if an item purchased in person is faulty, not as described or otherwise does not conform to the contract.

Where we voluntarily offer additional return rights for an in-person purchase, the applicable terms will be explained at the time of sale.

13. Product availability

Stock levels can change quickly and, occasionally, an item shown as available may become unavailable before we process an order.

If we are unable to supply an ordered product, we will notify you and refund any amount paid for that product.

We may impose reasonable limits on the quantity of particular products that may be purchased.

14. Promotions and discount codes

From time to time we may offer promotions, discounts or promotional codes.

Additional terms may apply to a particular promotion. Unless otherwise stated, promotional offers cannot be exchanged for cash and may be withdrawn or changed before an order is placed.

If specific promotional terms conflict with these Terms, the specific terms of that promotion will apply to the extent of the conflict.

15. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights in relation to goods.

If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was made.

Products sold through our consumer store are supplied for private and domestic use unless otherwise stated. If you use products for commercial, business or resale purposes, different legal considerations may apply.

16. Events outside our reasonable control

We will not be responsible for a failure or delay in performing our obligations where this results from circumstances outside our reasonable control.

Where such circumstances materially affect an order, we will take reasonable steps to minimise the impact and will contact you where appropriate.

Nothing in this section removes any statutory rights you may have, including rights relating to delayed or failed delivery.

17. Intellectual property

The COG Outlet name, branding, website design, original text, graphics and other content created by or for us are protected by applicable intellectual property laws.

Content belonging to manufacturers, suppliers, Shopify or other third parties remains the property of its respective owner.

You may use our website for personal and non-commercial purposes. You must not reproduce, distribute, commercially exploit or materially modify our original website content without permission, except where permitted by law.

18. Third-party services and links

Our website may contain links to or integrations with third-party websites, payment providers or services.

We are not responsible for the content or operation of independent third-party websites.

Your use of third-party services may also be subject to the relevant provider's terms and privacy policies.

19. Privacy and personal information

We process personal information in accordance with our Privacy Policy and applicable data-protection law.

Our store is hosted by Shopify and certain information may therefore be processed by Shopify and other service providers involved in operating the store, processing payments and fulfilling orders.

Please see our Privacy Policy for further information.

20. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to our business, website or applicable law.

The Terms applying to an order will normally be those in force when that order is placed.

The latest version will be available through our website.

21. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.

The remaining provisions will continue to apply.

22. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you will retain any mandatory protections provided by the law applicable to you and may have the right to bring proceedings in the courts of the part of the United Kingdom in which you live.

Nothing in these Terms is intended to deprive a consumer of any mandatory legal rights.
